These Terms & Conditions ("Terms") govern your use of the mobile application and any related services (collectively, the "App") provided by Christopher Donoso ("," "we," "us," or "our").
By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the App. By using the App, you represent that you meet this requirement.
2. Nature of the App
is a financial planning and retirement projection tool designed to help users estimate retirement outcomes based on information they provide, including savings, contributions, risk profile, retirement goals, and location assumptions.
The App is provided for informational and educational purposes only. It does not provide investment advice, financial advice, tax advice, legal advice, accounting advice, fiduciary services, or brokerage services.
Nothing in the App constitutes a recommendation to buy, sell, or hold any security or investment product.
3. No Professional Advice
The projections, estimates, tips, and planning insights in the App are based on assumptions, user inputs, and generalized modeling. Actual results may differ materially.
You should consult a qualified financial advisor, tax professional, attorney, or other licensed professional before making financial or retirement decisions.
4. User Inputs and Responsibility
You are solely responsible for:
- the accuracy of the information you enter into the App
- keeping your balances, contributions, assumptions, and profile information current
- any decisions you make based on the App's output
If you provide inaccurate, incomplete, or outdated data, the App's estimates and projections may be inaccurate.
5. Assumptions and Projections
The App may use assumptions relating to expected rates of return, inflation, retirement spending, Social Security estimates, cost-of-living adjustments, retirement age, and withdrawal assumptions.
These assumptions are not guarantees. Markets, inflation, taxes, laws, benefits, and personal circumstances can change over time. We do not guarantee that any projection, estimate, or target shown in the App will be achieved.
6. App License
Your use of the App is also subject to the applicable App Store terms and Apple's standard Licensed Application End User License Agreement unless otherwise stated.
You may not:
- copy, modify, reverse engineer, decompile, or disassemble the App except where prohibited by law
- resell, rent, lease, sublicense, or distribute the App
- use the App in a way that violates applicable law or infringes the rights of others
7. Purchases and Pricing
If the App is sold for a one-time purchase price, that payment grants you access to the version of the App made available at the time of purchase, subject to these Terms and the App Store's rules.
Unless otherwise required by law, all purchases are final and non-refundable except as provided by Apple or the applicable app marketplace.
We may change pricing for future purchases, updates, or premium features at any time, subject to applicable law and platform rules.
8. Data Storage, Sync, and Availability
The App may store data locally on your device and may use cloud syncing features where available.
We do not guarantee that:
- the App will be uninterrupted or error-free
- cloud sync will always be available
- data will never be lost, delayed, corrupted, or duplicated
You are responsible for reviewing your information regularly and maintaining your own records where appropriate.
9. Privacy
Your use of the App is also governed by our Privacy Policy.
Please review it carefully to understand how we collect, use, and store information.
10. Intellectual Property
The App, including its design, features, text, graphics, calculations, branding, and software, is owned by or licensed to Christopher Donoso and is protected by intellectual property laws.
Except for the limited right to use the App under these Terms, no rights are granted to you.
11. Acceptable Use
You agree not to:
- use the App for unlawful, fraudulent, or misleading purposes
- interfere with the operation or security of the App
- attempt unauthorized access to any systems or data
- use automated tools to scrape, probe, or overload the App
- misuse educational content or outputs as professional advice to third parties
12. Third-Party Services and Links
The App may reference or link to third-party services, websites, or resources, including government or financial websites such as Social Security resources.
We do not control and are not responsible for any third-party content, policies, products, or services.
13. Disclaimer of Warranties
To the maximum extent permitted by law, the App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, reliability, or non-infringement.
We do not warrant that:
- the App will meet your expectations or requirements
- results or projections will be accurate or suitable for your circumstances
- the App will always be available, secure, or free from bugs
14. Limitation of Liability
To the maximum extent permitted by law, Christopher Donoso and any affiliates, contractors, or licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, savings, goodwill, data, business opportunities, or financial outcomes arising from or related to your use of the App.
To the maximum extent permitted by law, total liability for any claim arising out of or relating to the App or these Terms will not exceed the amount you paid for the App, if any.
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Christopher Donoso and any affiliates, contractors, and licensors from claims, damages, liabilities, and expenses arising out of:
- your use or misuse of the App
- your violation of these Terms
- your violation of applicable law
- your infringement of any third-party rights
16. Termination
We may suspend or terminate your access to the App or certain features if you violate these Terms or if continued operation of the App is no longer feasible.
Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnification, and governing law.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may provide notice by updating the date above, through the App, or by other reasonable means.
Your continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms.
18. Governing Law
These Terms are governed by the laws of the United States and, to the extent applicable, the laws of the state in which Christopher Donoso resides, without regard to conflict of law principles, except where otherwise required by applicable law.
Any disputes arising from these Terms or the App shall be resolved in the appropriate state or federal courts in the United States, unless applicable consumer law provides otherwise.
